Time to Abolish the ATF

Adamiak has an expert witness, I hope, preferably one with access to the original exhibits. Otherwise, I fear that the judge will simply accept the false Government assertions based on Bodell's idiotic conclusions.

Judges are the problem here, and have been for a long time.

Federal appellate courts don’t review evidence, only issues of law.

3 years for an appeal is ridiculous. They're going to owe Patrick a lot of money which the ATF should pay out of their budget. Then shut them down for good, this is typically what the ATF does is harass and convict / kill innocent people. If I were president, I would pull every dime from them. Congress needs to act before they kill some other innocent civilian. ABOLISH THE ATF!!!!!

Excellent article.

As a retired LEO of 50 years combined service in State and Municipal positions, and a police watch commander, I am disturbed by what I consider illegal conduct on the part of the ATF agent. Aside from perjurious testimony, this agent tampered with evidence in order to create a 'machine-gun' where none ever existed. By this time the ATF should have taken disciplinary action against this agent, and if they have not they are compliant in his criminal misuse of his authority. In addition the DOJ on learning of these lies and alterations of the evidence should have invoked a Brady disqualification on the agent, rendering any future testimony in court inadmissible. In essence a Brady disqualified agent is no longer able to function as an LEO.

The ATF is still running loose and out of control. This agency needs to be stripped and returned to their former status of collecting excise taxes on alcohol and tobacco: They have no standing to be a valide LE organization anymore and moving them to DEA simply exacerbates the problems.

““Based on trial testimony…and Bodell’s report…the district court did not clearly err…Thus, all the firearms were NFA firearms...””. So, does this not show that she has done NO work of her own to verify the VALIDITY of the rookie ATF agent’s “testimony” and “report”? Doesn’t that mean she should share in the responsibility / repercussions of any wrongdoing?

“…unregistered machinegun and unregistered destructive devices…” – Does this not prove that the intent of the NFA “tax” is indeed a gun “registration” scheme? If it was truly a “tax”, why doesn’t Jacqueline R. Bechara, the Assistant United States Attorney handling the appeal say “untaxed” instead of “unregistered”?

Since “[t]he same parts are still legally sold online…”, why isn’t the ATF CURRENTLY pursuing EQUAL prosecution of EVERYONE who bought them and EVERYONE who is CURRENTLY selling them, with EQUAL fervor? How does this demonstrate DOJ’s supposed pursuance of “blind” justice?

Please consider a pardon for Patrick “Tate” Adamiak.

I believe he was wrongfully arrested by the ATF on manufactured firearm violations, using “evidence” that was misleading, at best, and/or fraudulent, at worst.

Mr. Adamiak was serving in the Navy (to this day, the Navy has taken NO disciplinary actions against him) when the ATF sent a CI who was “cooperating with the ATF to work off charges of his own” to start a ““fishing expedition””.

After a seemingly very flawed trial, he was convicted and is currently serving a 20-year sentence in a federal prison.

I am listing several articles below that contain numerous details and links to source documents that, I believe, vindicate Mr. Adamiak.

Thank you very much for your consideration of righting this wrong.
